The subject telephone call was referred to my by Mark Senwimmer. I explained the same information to him as was given to Yokohama Tire Corp. and Transportation Testing, Inc. (Aug. 27 memo). The caller stated that his company must prepare for "the worst," which, he concluded, would be the Court lifting the stay without extending the effective dates, and therefore should commerce testing at San Angelo. I responded that while that may be his company's business judgment, the agency had taken no position in this regard subsequent to the issuance of the stay order.
