TEXT: This confirms your conversation of May 9, 1978, with Roger Tilton of my staff concerning the applicability of the school bus safety standards to smaller van-type vehicles. As Mr. Tilton indicated, a vehicle that transports 9 passengers and a driver is not considered a school bus and need not comply with the school bus safety standards. A vehicle that transports 10 passengers and a driver is a school bus and must comply with all of the applicable school bus safety standards.
